1/ Basic provisions
1. This Privacy Policy for company: Radim Slovák - JA-RA, IČ: 01026461 DIČ: CZ7805313593, with registered office: Na Pančavě 519, 538 51 Chrast, (hereinafter referred to as "the Administrator") regulate the principles of processing personal data of website visitors www.seleste.cz (hereinafter referred to as the "Website"), especially their registered users (hereinafter referred to as "user") and customers who place an order through the website (hereinafter referred to as "Customer").

3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, a network identifier or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
2/ What personal data we process
1. Data provided by customers. We process personal data about users and customers. Primarily, the personal data that you provide to us when you register or create your order is processed.
This data includes in particular the e-mail address and, in the case of customers, the name, address, telephone number and payment details. If you wish, you can also provide other details such as your employment address or a note about possible delivery times.
2. Data from Facebook. We do not collect any personal data from Facebook.
3. Data collected through cookies. If you have enabled the storage of cookies in your browser and agree to their use, we collect data about your visit to the website, products viewed and other activity on the website. We certainly do not collect or otherwise process any sensitive personal data including, for example, data about your health, religion or beliefs, etc.
3/ Lawful reason and purpose for processing personal data
1. The lawful reason for processing personal data is
* the performance of the contract between you and the administrator pursuant to Article 6 paragraph 1. b) GDPR,
* the legitimate interest of the controller in providing direct marketing (in particular for sending commercial communications and newsletters) according to Article 6 paragraph 1. f) GDPR,
* Your consent to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) Article 6 paragraph 1. a) GDPR in conjunction with § 7 para. 2 Act n. 480/2004 Sb., on certain information society services in the absence of an order for goods or services.
2. The purpose of the processing of personal data is
* the processing of your order and the exercise of the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data are required that are necessary for the successful processing of the order (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data, it is not possible to conclude the contract or its performance by the controller,
* sending commercial communications and doing other marketing activities.
4/ Data retention period
1. JA-RA – Radim Slovák processes personal data for the purpose of contract performance throughout the processing of the order, including payment and delivery of the goods. By law, we subsequently store certain data contained in accounting documents.
2. Commercial communications are sent to users for as long as the consent to receive them lasts. In the case of customers, commercial communications are sent until unsubscription or until you object to the processing of your data for this purpose. However, commercial communications are sent for a maximum period of 5 years. Thereafter, we will ask you to grant a new consent.
3. We process the data collected for marketing purposes via cookies for as long as you consent to the use of cookies, i.e. for as long as you allow the storage of cookies in your browser or until you object to the processing of your data for this purpose.
4. Further processing of personal data beyond these time limits is carried out by JA-RA – Radim Slovák only if it is necessary to comply with legal obligations that apply to JA-RA – Radim Slovák apply.
5/ Who has access to personal data (subcontractors of the controller)
1. Your personal data is handled mainly by our employees involved in the processing of your order and delivery of goods or services.
2. The controller also delegates the processing of personal data to other entities, as so-called processors. A processor is any entity that processes personal data for JA-RA - Radim Slovák for the purposes and in the manner we specify. This includes, for example, a company providing transport of orders, providing e-shop operation services, our external accounting company and the like.
3. providing marketing services - in particular Mailchimp (newsletter distribution), Facebook Inc. and Google LLC (online marketing tool) and others.
4. The controller transfers personal data to a third country (a country outside the EU) or an international organisation. Recipients of personal data in third countries are only providers of mailing services (Mailchimp) / cloud services.
6/ What are your rights
In connection with the processing of personal data, you can contact us and request:
* Information about the personal data we process, the purpose and nature of the processing of personal data, including information about possible recipients of personal data outside JA-RA - Radim Slovák.
* Access to the data you have provided to us.
* Correction of personal data if it is inaccurate or incomplete in any way.
* Explanation and rectification of the defect (e.g. blocking, correction, completion or destruction of personal data),
* Erasure of personal data (the so-called right to be forgotten) or their limited processing if they are no longer necessary for the stated purposes. We will destroy your data wholly or partially in accordance with these conditions.
* the right to withdraw consent to the processing in writing or electronically to the address or email of the controller referred to in Article I, paragraph 2 of these terms and conditions.
* You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
7/ Personal data security conditions
1. JA-RA - Radim Slovák cares about the security of your data. The handling of your personal data is fully in accordance with applicable legislation, including the General Data Protection Regulation (GDPR). When processing personal data, JA-RA - Radim Slovák places great emphasis on the technical and organizational security of the processed data.
2. All personal data in electronic form shall be stored in databases and systems to which only those persons who have an immediate need to handle the personal data for the purposes set out in this policy have access, and only to the extent necessary. Access to this personal data is password and firewall protected. The security of personal data is regularly tested by JA-RA - Radim Slovák and the protection is continuously improved.
8/ Final provisions
1. By submitting an order from the online order form, you confirm that you are aware of the privacy policy and that you accept it in its entirety.
2. You agree to these terms and conditions by checking the consent box via the online form. By checking the consent form, you confirm that you are aware of the privacy policy and that you accept it in its entirety.
3. The administrator is entitled to change these conditions. It will publish the new version of the Privacy Policy on its website and will also send the new version of the Privacy Policy to the email address you have provided to the controller.
4. These terms and conditions take effect on 18.1.2022.
